When the Founder Fathers created the Constitution, they developed a system in which three branches would evaluate each other as a means prevent a particular branch from dominating the government.

  1. The initial purpose of the Judiciary Act of 1789 was to establish and appropriately structure a federal court system. Although, arguably the most important offset stemming from it was the creation of the United States Supreme Court and judicial branch.
    I deem the Judiciary Act of 1789 to constitute as a check on all three branches, by enabling the Supreme Court the power to oversee court decisions questioning the constitutional validity of both federal and state statutes- surely within the accumulation of issues each court is designated within.
    Based on the activity, I believe the legislative branch has the most powerful check on the other branches because they can prohibit laws from being passed, and even override presidential decision.

  2. The Draft of Motion Rule for Marbury v. Madison proved to show the new idea of judicial review and the Supreme Court actions over the other two branches of Government. This came to show the system of checks and balances of the Supreme Court to prevent either one of the two branches of federal government from becoming too powerful. This document comes to show the check that it had over all three branches through the Supreme Court declaring a law unconstitutional and the role that it gained of being able to invalidate Federal and state laws that were going against the Constitution.
    Based on the documents all included in the activity, especially the very first matching one, I saw the Legislative Branch having the most powerful checks over the other branches because not only of its checks being over both branches and over multiple times, it also has the powerful to overriding vetoes and having Impeachment Power over the other branches.
